This Continuing Disclosure Agreement (the "Agreement"), dated as of , 2019, is executed and delivered by the Texas Department of Housing and Community Affairs (the "Department") and The Bank of New York Trust Mellon Company, N.A., as Trustee, in connection with the issuance of the Department's Single Family Mortgage Revenue Bonds, 2019 Series A (the "Series 2019 Bonds"). The Series 2019 Bonds are being issued pursuant to an Amended and Restated Single Family Mortgage Revenue Bond Trust Indenture, dated as of June 1, 2017, between the Department and The Bank of New York Mellon Trust Company, N.A., as Trustee, Paying Agent, and Registrar for the Series 2019 Bonds issued by the Department thereunder (the "Trustee"). All capitalized terms not defined in this Agreement shall have the meanings assigned to them in the Trust Indenture. For good and valuable consideration, the Department and the Trustee, covenant and agree as follows:
