This class action settlement agreement (“Agreement” or “Settlement Agreement”) is entered into as of February 21, 2017, by and among Abante Rooter and Plumbing, Inc. (“Plaintiff”), individually and on behalf of the class of persons it seeks to represent (the “Settlement Class” defined below at ¶1.23), and New York Life Insurance Company (“New York Life”) (Plaintiff and New York Life are collectively referred to as the “Parties”). This Settlement Agreement is intended by the Parties to fully, finally, and forever resolve, discharge, and settle the Released Claims (defined below at ¶1.16), upon and subject to the terms and conditions of the Agreement, and subject to the final approval of the Court.
