This Master Subscription Agreement (“Agreement”), entered into by and between Higher Logic, LLC (“Higher Logic” or “Service Provider”), a Delaware limited liability company, and the customer identified on the signature line (“Subscriber”), governs the order, provision and use of the Higher Logic services described on each order form executed by the parties (“Order Form”) which includes a hyperlink or other reference to this Agreement and/or to which this Agreement is attached, which services (a) may include (i) Higher Logic’s cloud-based community platform, (ii) Higher Logic’s cloud-based marketing automation and analytics platform, and/or (iii) other Higher Logic cloud-based service offerings described on the Order Form (collectively, and together with all updates thereto, the “Software Services”) and (b) may include Professional Services (as defined below).
