Boyden and Client respect the fundamental rights of employees and candidates. The parties agree to keep personal data of candidates and employees confidential and process such data only for the purposes laid out in this Agreement. Where Boyden collects and processes personal data of potential candidates and/or employees of the client, Boyden acts as a Controller (as defined in Article 4 No. 7 of the European General Data Protection Regulation - GDPR). In the event that the Client provides personal data of potential candidates or employees to Boyden for recruitment, leadership or talent advisory purposes and the consent of the candidate or employee for such a transfer could not be obtained, the Parties agree to enter into a separate processor controller agreement provided by Boyden (“Boyden Client PCA”).
