PROPERTY (this “Agreement”) is made, entered into, on [DATE] and shall become effective on the Commercial Operation Date (defined below) (the “Effective Date”) by and between GHTJA04 LLC, a Delaware limited liability company, registered as a foreign limited liability company in the Commonwealth (“Developer”), and the Town of Hopkinton, a municipal corporation duly established and located in the Commonwealth of Massachusetts (the “Town”). Developer and the Town are collectively referred to in this PILOT Agreement as the “Parties” and are individually referred to as a “Party”.
