This FIRST AMENDMENT TO MASTER SERVICES AND PURCHASING AGREEMENT (“FirstMaster Services and Purchasing Agreement • July 13th, 2022
Amendment”) dated (“First Amendment Effective Date”) to the Agreement dated April 09, 2021(“Agreement”), as amended, between AXON ENTERPRISE, INC., a Delaware corporation, fka TASER International Inc., (“Axon”) and the City of Bend acting by and through the Bend Police Department, (“Agency”) is entered by such parties to amend the Agreement as set forth in this First Amendment. Axon and Agency may also be referred to in this First Amendment individually as “Party” or collectively as “Parties.” To the extent this First Amendment contains terms and conditions that differ from those contained in the Agreement, this First Amendment shall control. The Parties agree that a concept or principle covered in this First Amendment shall apply and be incorporated into all other provisions of the Agreement in which the concept or principle is also applicable, notwithstanding the absence of any specific cross-reference thereto.
