This Settlement Agreement (“Agreement”) is made and entered into, subject to final approval by the United States District Court, Western District of Tennessee, Western Division (the “Court”), by and between (1) Mabelean Wade (“Wade”) on behalf of herself and all others similarly situated on the one hand, and (2) Defendant Foremost Insurance Company Grand Rapids, Michigan (“Foremost”), on the other hand. Wade and Foremost are each a “Party” and, together, are collectively referred to herein as the “Parties.”
