This SPLUNK INC. UNITED STATES DEPARTMENT OF DEFENSE COMPONENT AGENCY TERM SOFTWARE LICENSE AGREEMENT sets forth the United States Department of the Defense (DoD) component agency (hereinafter “Licensee”) software license requirements for SPLUNK INC. (hereinafter “Licensor” or “Publisher”) on-premise software and support thereof (hereinafter “Agreement”). Licensor’s Software License Agreement (hereinafter “SLA” or “Exhibit A”) applicable to Licensor’s on-premise software licenses and Support thereof is attached hereto as Exhibit A and made a material part hereof by this reference. This Agreement, including the SLA, constitutes the agreement between Licensor and Licensee. The terms and conditions set out in the clauses immediately below and any amendments hereto, supplement, and to the extent a conflict exists, supersede, and take precedence over the terms and conditions of the SLA.
