This Joint Controller Agreement ("Agreement") is made and entered into between Advanced Brain Monitoring, Inc. ("ABM") and a Commercial Customer ("Customer") of ABM's products and services. ABM and Customer have agreed to enter into this Agreement for the purposes of ensuring compliance with the European Union (EU) General Data Protection Regulation (GDPR), which is effective as of May 25, 2018. ABM and Customer have agreed that they are Joint Controllers as defined by Article 26 of the GDPR as both ABM and Customer jointly determine the purposes and means of processing personal data.
