This Guaranteed Energy Savings agreement, referred to herein as "Agreement" or "GES", dated as of , 200 , by and between the _insert State/County agency_ with primary offices located at _insert address_, Hawaii, referred to herein as the "CUSTOMER" and _insert ESCO with primary offices located at _insert address , , referred to hereafter as the "COMPANY” for the purpose of providing energy conservation measures (ECMs), consisting of services, systems and facilities designed to reduce energy consumption and costs in buildings owned and operated by the CUSTOMER which are referred to herein as the "Premises." The CUSTOMER and the COMPANY are also referred to herein as the "Party" or "Parties" as appropriate. This GES agreement will be used as the “scope of work” for execution of a GES contract. Terms and conditions for the GES contract will be set forth in the State/County agency “boiler plate template” for design-build construction contracts.
