THIS BUSINESS ASSOCIATE PRIVACY AND SECURITY AGREEMENT (the “Agreement”) is made and effective this day of , 20 (the “Effective Date”), by and between CONSULTANT and TARC, Inc. The purpose of this Agreement is to set forth the mutual obligations of the parties regarding the protection of the privacy of medical information subject to the Standards for Privacy of Individually Identifiable Health Information (the “Privacy Rule”) and the Security Standards and Implementation Specifications (the “Security Rule”), under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, as amended (“HIPAA”) and the regulations promulgated thereunder.
