The aim is to draw attention of the academic community and clinical research sites in Brazil to the particularities and complexities of the clinical trialagreement. We begin with a brief contextualizationabout “atypical contracts” to verify that this is a“purely atypical” contract. Hereafter, we indicate its main clauses and, from a personal experience, the analysis will be critical and pointing out provisions to be questioned by the clinical sites: either becauseit they are unfavorable, or not applicable by Brazilian legal system. Still we indicate the inherent provisions that do not open scope for negotiation, and must be fully adhered to by the Site. It is expected that, with this article, clinical sites in Brazil may have a tool in their favor for the analysis and negotiation of this agreement, making its negotiation and celebration faster and with true equality between the parties.
