This Settlement Agreement and Release (“Settlement Agreement”) is entered into by and between (i) Matthew Kocher, Mark Rogolino, and James Jackson (“Plaintiffs” or “Settlement Class Representatives”), individually and on behalf of the Settlement Class (defined below); and (ii) Builders Mutual Insurance Company and Builders Mutual Insurance Company, Inc. (“Defendants” or “Builders Mutual”) in the case In re: Builders Mutual Data Security Incident Litigation, Case No. 5:23-CV-579-M-KS, United States District Court for the Eastern District of North Carolina, Western Division. Builders Mutual and Plaintiffs are collectively referred to herein as the “Parties.” The lawsuit being resolved is referred to herein as the “Litigation.”
