(this “Agreement”) entered into as of this day of November 2020 (the “Execution Date”), in consideration of the mutual promises contained herein by and between John Handel, of 25 Drake Street, Yarmouth Port, MA 02675 (the “DEVELOPER”); and the Stow Planning Board (the “BOARD”) acting on behalf of the Town of Stow, Massachusetts (the “TOWN OF STOW”) and pursuant to the Board’s authority found in the Stow Zoning Bylaw and G.L. c.41, having its offices at 380 Great Road, Stow, Massachusetts 01775. The sole purpose of this Agreement is to insure the Town of Stow against potential failure to comply with the certain requirements contained in Condition 8.26, Condition 8.47 and Condition 8.63 of the BOARD’s Erosion Control Special Permit and Hammerhead Lot Special Permit and Definitive Subdivision Decision filed with the Town Clerk on May 22, 2015 and recorded with said Registry in Book 65702, Page 578, as amended and extended (“DECISION”) requiring, in relevant part, performance guarantee to
