WHEREAS, Plaintiff’s FAC in the Lawsuit alleges that Defendant unlawfully and abusively attempted to collect a debt due and/or owed by Plaintiff by transmitting unsolicited automated calls using an artificial or pre-recorded voice to Plaintiff and members of the Settlement Classes without the recipients’ prior express invitation or permission, thus violating the Telephone Consumer Protection Act (the “TCPA”), 47 U.S.C. § 227, et seq. and the Rosenthal Fair Debt Collection Practices Act (the “RFDCPA”), Cal. Civ. Code § 1788, et seq.;
