This Data Processing Addendum (“Addendum” or “DPA”) supplements the Enterprise Terms of Service (the “Agreement”) entered into by and between (“Customer”) and Sigma Computing, Inc. (“Sigma”). By executing the Addendum, Customer enters into this Addendum on behalf of itself and, to the extent required under applicable Data Protection Laws (defined below), in the name and on behalf of its Affiliates (defined below), if any. This Addendum may refer to Customer and Sigma each as a “Party” and collectively as the “Parties.” This Addendum incorporates the terms of the Agreement, and any terms not defined in this Addendum shall have the meaning set forth in the Agreement. In the event of a conflict between the terms and conditions of this Addendum and the Agreement, the terms and conditions of this Addendum shall supersede and control.
