This Settlement and Release Agreement (“Agreement” or “Settlement Agreement”) is entered into by and between DaVita Inc. (“DaVita” or “Defendant”), and Kenneth Koskosky, Victoria Witherby, and Sandra Hoover (“Plaintiffs”), both individually and on behalf of the Settlement Class, in the case of Kenneth Koskosky, Victoria Witherby, and Sandra Hoover v. DaVita Inc., Case No. _ , currently pending in the Seventeenth Judicial District in and for Broward County, Florida. Defendant and Plaintiffs are each referred to as a “Party” and are collectively referred to herein as “the Parties.”
