This Crossing Agreement (“Agreement”) is made and entered into this day of April, 2024 by and between the City of New York (“City”) through the New York City Department of Environmental Protection, registered in the State of New York (the “NYCDEP”), whose office is at 59-17 Junction Boulevard, Flushing, NY 11373, 19th Floor, SBMT Asset LLC (“SBMT Asset”), a Delaware limited liability company, whose office is at 600 Washington Blvd, Suite 800, Stamford, CT 06901, and Empire Offshore Wind LLC, a limited liability company registered in the State of Delaware (“Empire Wind”, and together with SBMT Asset, the “Equinor Parties”) whose office is at 600 Washington Blvd, Suite 800, Stamford, CT 06901, each of which is referred to herein individually as a “Party” or together as the “Parties”.
