is entered into as of this 31 day of March. , 20 16 by and between the APPENZELL OWNERS’ ASSOCIATION, INC., a Utah non-profit corporation NEWPORT RESET, LLC (hereinafter called "Developer"), and the CITY OF MIDWAY, a political subdivision of the State of Utah (hereinafter called the "City"). Developer and the City are, from time to time, hereinafter referred to individually as a "Party" and collectively as the "Parties." Unless otherwise noted herein, this Agreement supersedes and replaces any previous development agreements involving the same Property (defined below), including that certain "High Valley Ranch P.U.D. Development Agreement" recorded August 8, 2007 as Entry Number 324339, Wasatch County Records, and is the entire, complete Agreement between the Parties.
