WHEREAS the Town had entered into a Site Plan Control Agreement dated July 6th, 2006 (the “Site Plan Control Agreement”) with Two Mountain Road, Collingwood, Inc. (the “Former Owner”), which was registered on title as Instrument No. SC471277 on August 24th, 2006 over the lands described in Schedule “A” of the Site Plan Control Agreement (the “Lands”) for development of the Blue Mountain Centre commercial plaza, including a movie theatre and retail stores;
