PROOF OF CONCEPT TERM LICENSE CONTRAT DE LICENCE A TERME POUR PREUVE D’UN CONCEPT (OU « POC ») This Proof of Concept Term License Agreement (”Agreement”) is entered into by and between MicroStrategy and the Licensee named in the signature block as of the date on which Licensee has executed this Agreement and MicroStrategy has accepted it as provided in Section3.2 (the “Effective Date”). As used in this Agreement, MicroStrategy shall mean the MicroStrategy entity that accepted the order from Licensee, i.e. (a) for orders shipped to the United States or Canada, MicroStrategy is MicroStrategy Services Corporation; (b) for orders shipped to countries where MicroStrategy has a subsidiary, MicroStrategy is the MicroStrategy subsidiary in that country; (c) for all other countries, MicroStrategy is MicroStrategy Limited.
