This Settlement Agreement and Release (“Settlement” or “Agreement”) is made and entered into by and between (1) Plaintiffs Michael Allagas, Arthur Ray, Brett Mohrman, and Brian Dickson (collectively “Plaintiffs”), individually and as Class Representatives of the “Settlement Class” (defined below); (2) Defendant BP Solar International, Inc. (“BP”) (defined below); and (3) Defendant Home Depot U.S.A., Inc. (“THD”) (defined below). BP and THD are collectively referred to as the “Defendants.” Plaintiffs, the Settlement Class, BP, and THD are collectively referred to as the “Parties.”
