This Data Processing Agreement (“DPA”) forms part of the agreement or other written or electronic agreement between “Bizagi” and “Customer” for the purchase of services from Bizagi (the “Agreement”). This DPA applies to all activities performed in connection with the Agreement in which the staff of Bizagi, Sub-Processors or a third party acting on behalf of the Processor may come into contact with personal data of the Customer. By signing the DPA, Customer enters on behalf of itself and, to the extent required under applicable Data Protection Laws and Regulations, in the name and on behalf of its Affiliates, if and to the extent Bizagi processes Personal Data for which such Affiliates qualify as the Controller. For the purposes of this DPA only, and except where indicated otherwise, the term "Customer" shall include Customer and Affiliates and is effective as of the date of the last party to sign this DPA (the “Effective Date”).
