This Data Processing Agreement (this “DPA”) is incorporated into, and is subject to the terms and conditions of the Master Subscription Agreement and any applicable Order Form (collectively, the “Agreement”) made by and between the customer that is a party to the Agreement (the “Customer”) and Equipat IP LLC, a Georgia limited liability company (the “Company”), and reflects the Parties’ agreement with regard to the Processing of Customer Personal Data (each as defined below). In the course of providing the Services to the Customer pursuant to the Agreement, the Company may Process Customer Personal Data on behalf of the Customer and the Parties agree to comply with the following provisions with respect to any Customer Personal Data. If there are any conflicting terms and conditions in this DPA and the Agreement, the terms herein shall supersede and replace those of the Agreement.
