PURPOSE/DEFINITIONS: These General Provisions are intended to be incorporated into and become a part of agreements (“Contracts”) between third parties and either Tesoro Refining and Marketing Company, a Delaware corporation, Tesoro Alaska Company, a Delaware corporation, or Tesoro Hawaii Corporation, a Hawaii corporation (collectively “Tesoro”), covering the purchase and sale of Marine Fuel. A Contract will consist of typed, facsimile, telex or other written Specific Provisions, these General Provisions, attached Exhibits and any addenda or other terms that may be specifically incorporated by reference. In the event of any conflict between the Specific Provisions and these General Provisions, the Specific Provisions shall prevail over these General Provisions. No Contract shall be effective until the portion setting forth the Specific Provisions has been executed by an authorized representative of Tesoro, provided that these General Provisions may apply to all volumes of Marine Fuel ac
