THIS INTERLOCAL AGREEMENT, dated as of this day of , 2008 (the "Utility Acquisition Interlocal Agreement"), by and between the FLORIDA GOVERNMENTAL UTILITY AUTHORITY, a legal entity and public body created by interlocal agreement pursuant to section 163.01(7), Florida Statutes (the "FGUA"), and PASCO COUNTY, FLORIDA, a political subdivision of the State of Florida (the "County"), each constituting a "Public Agency" under Part I of Chapter 163, Florida Statutes, (the "Interlocal Act").
