This Agreement (the “Agreement”) is made and entered into as of March 25, 2019 (“Commencement Date”) by and between MIDLAND INDEPENDENT SCHOOL DISTRICT, a public independent school district and political subdivision of the State of Texas, (“MISD”) and REACH Network, a Texas non- profit corporation (“Operating Partner” or “OP”) (together, the “Parties”) to operate REACH Network inclusive of Ralph Bunche Elementary School (the “School” ) beginning on July 1, 2019. The purpose of this Agreement is to set forth the objectives, understandings, and agreements of the Parties in connection with the establishment and operation of Senate Bill No. 1882, adopted by the 85th Texas Legislature in 2017, codified as Texas Education Code (“TEC”) §§ 11.174 and 42.2511 (“SB 1882”), which allows this cooperative partnership between a public education institution and a non- profit corporation to operate an in-district charter authorized under TEC Chapter 12, Subchapter C.
