This Agreement Regarding the Evaluation of Desalination Plant and Proposal (the “Agreement”) is made and entered into effective as of the 16th of January, 2018 (the “Effective Date) by and between the Port of Corpus Christi Authority of Nueces County, Texas, a navigation district operating under Article XVI, Section 59 of the Texas Constitution (“Authority”), and the City of Corpus Christi, Texas, a municipal corporation and home rule city of the State of Texas (“City”). Authority and City are sometimes referred to in this Agreement as “Parties” and individually as a “Party”.
