SETTLEMENT AGREEMENT BETWEEN THE UNITED STATES OF AMERICA AND PARADISE REALTY CORPORATION and DA VINCI HOTEL CORPORATION WHEREAS, the Americans with Disabilities Act of 1990 ("ADA"), 42 U.S.C. §§ 12181 et seq., provides, among other things, that "[n]o individual shall be discriminated against on the basis of disability in the full and equal enjoyment of the goods, services, privileges, advantages, or accommodations of any place of public accommodation by any person who owns, leases (or leases to), or operates a place of public accommodation," 42 U.S.C. § 12182(a); and WHEREAS, the term "public accommodation" under the ADA includes "an inn, hotel, motel, or other place of lodging," 42 U.S.C. § 12181(7)(A); and WHEREAS, the ADA authorizes the United States Department of Justice to "undertake periodic reviews of compliance of covered entities," 42 U.S.C. § 12188(b)(1)(A)(i); and WHEREAS, on May 5, 2005, pursuant to its authority under 42 U.S.C. § 12188(b)(1)(A)(i), the United States Attor
