THIS AMENDMENT NO. 4 is entered into by and between the Texas Facilities Commission (hereinafter referred to as “TFC”), a state agency located at 1711 San Jacinto Boulevard, Austin, Texas 78701 and Posillico Civil, Inc., located at 9811 South IH 35, Building 6 Suite 100, Austin, Texas 78744 (hereinafter referred to as “DB,” or “Design-Build Firm”) (hereinafter collectively referred to as the “Parties”) to amend the Design-Build Agreement (hereinafter referred to as the “Agreement”), as amended.
