THIS PUBLIC TRAIL MAINTENANCE AGREEMENT (“Agreement”) is made and entered into as of , 2018 (“Effective Date”) by and between Orchid Homeowners Association, a California non-profit mutual benefit corporation (“HOA”) and CITY OF MILPITAS, a municipal corporation of the State of California (“City”). HOA and the City may collectively be referred to herein as the “Party” or the “Parties”.
