The terms of this agreement (this “Agreement”) consist of: (1) these Terms and Conditions for the ETF IOPV Calculation Services (“Terms and Conditions”); (2) an Order Schedule making reference to these Terms and Conditions (the “Schedule”) entered into between ICE Data Indices, LLC (“ICE Data”), a Delaware corporation, having an office at 100 Church Street, New York, New York, 10007 and Customer identified in such Schedule (the “Customer”). ICE Data and Customer each being a “Party” and, collectively, the “Parties”.
