This is a user agreement between you and Northeast Merchant Systems, Inc. d/b/a NanoKard (“NanoKard”, “we”, “us” or “our”), governing your use of NanoKard’s mobile payment application and platform (the “Services”). This user agreement and the agreements, policies, and documents referenced and therefore incorporated herein (“Agreement”, “User Agreement”, “Terms”, or “Terms of Service”), constitute a legally binding contract between you and NanoKard. This Agreement contains provisions that govern how claims between you and NanoKard are resolved, including a mandatory binding arbitration clause and a class action waiver.
