This is a legal agreement between you (either an individual or an entity) and Software FX, Inc. (Li- censor) regarding the PowerGadgets Mobile iOS Client Software application you have chosen to download from the Apple store website (the “Apple Site”) located at www.apple.com/iphone/app- store/. Both Licensor and you acknowledge that this Agreement is between Licensor and you, and that Apple, Inc. and/or its subsidiaries are not a party to this Agreement. By installing the Software you are agreeing to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, promptly request a refund from Apple as described later in this Agreement.
