The Recipient has acknowledged and agreed to the terms and conditions set out below for using any sample of microorganisms it has obtained from NPMD pursuant to Rule 11.2(ii) of the Regulations (the “Regulations”) under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure and any microorganisms it has derived from the furnished sample through cultivation, duplication, amplification, or otherwise (collectively with the sample of microorganisms, the “Microorganism”).
