SUBJECT: Model Dairy Property Agreement(s) Necessary for the Renewal of the Consolidated Water Use Permit - Delegate Authority to the General Manager - Approve

Tampa Bay Water is required to mitigate the historic impact to one wetland at the Cypress Creek Wellfield to complete the renewal of the Consolidated Water Use Permit (CWUP). This wetland cannot be mitigated onsite due to flooding concerns on adjacent properties. Tampa Bay Water has remaining wetland mitigation credits at the Model Dairy mitigation site that we have proposed to use as mitigation for the single impacted wetland. Tampa Bay Water's Agreement with Hillsborough County to maintain the Model Dairy mitigated wetlands expired in January 2013. In order to withdraw the necessary wetland mitigation credits, the District is requiring that Hillsborough County grant Tampa Bay Water sufficient property rights to withdraw the credits and to maintain the restored wetlands in perpetuity as part of the Consolidated Water Use Permit renewal.
