This document (the “Agreement” or “Terms”) is a legally enforceable contract between the corporation or other legal entity set forth on the Order Form (referred to herein as “you,” “Customer” or “End User”) and LogicMonitor, Inc. (referred to as “LogicMonitor,” “we,” “our”, “us” or the “Company”) regarding the use of the Company’s hosted data center monitoring services (“Service” or “Services”) and software programs accompanying or provided under this Agreement (the “Software”) together with the associated media, corresponding Documentation, technical configurations, and technical data (collectively with the Service, the “LogicMonitor Technology”). “Documentation” means the user’s guide and other documentation (including print and online), if any, provided to you with in connection with the Service or Software. “Subscriber” means the contracting party (i.e. the Reseller or Payment Intermediary) who has subscribed to the Services with LogicMonitor on either a trial or fee- bearing basis
