THIS AGREEMENT by and between City of Kyle, Texas and Monarch Utilities I, LP (the “Agreement”) is entered into between the CITY OF KYLE, TEXAS, a Texas home-rule city (the “City”), and MONARCH UTILITIES I, LP, an investor-owned utility that provides water service within the corporate boundaries and extraterritorial jurisdiction of the City (“Monarch”). In this Agreement, the City and Monarch are sometimes individually referred to as a “Party” and collectively referred to as the “Parties”.
