This COST REIMBURSEMENT AGREEMENT (the “Agreement”), is made and entered into as of April 5, 2017 (the “Effective Date”), by and between NEW ATHENS GENERATING COMPANY, LLC, having an office and place of business at 9300 U.S. Highway 9W, P.O. Box 349, Athens NY 12015 (“Customer”) and NIAGARA MOHAWK POWER CORPORATION d/b/a National Grid, a corporation organized and existing under the laws of the State of New York, having an office and place of business at 300 Erie Boulevard West, Syracuse, New York 13202 (the “Company”). Customer and Company may be referred to hereunder, individually, as a “Party” or, collectively, as the “Parties”.
