In this proceeding, KI acknowledges that it sold the Gravel Pits to DRB, but claims that the transaction involving the Industrial Property was not a sale, but rather an equitable mortgage. DRB disagrees and asserts clear title to all four parcels. This ruling resolves this dispute, at least at the trial level…for now.
