PERMITTEE intends to install fiber-to-the-premises (“FTTP”) infrastructure that will provide communication services, including Internet and video services in the CITY (“PROJECT”) as further described in the November 17, 2015 memorandum to the San José City Council which is attached hereto as Exhibit A and in the Mitigated Negative Declaration (“MND”), File No. PP15-049 adopted by the San José City Council with this Permit, and any addendum(s), each of which are incorporated into this Permit by reference as if set forth fully herein.
