THIS AGREEMENT made and entered by and between City of Bastrop, a Texas municipal corporation, hereinafter designated the “CITY” or “OWNER”, and Archer Western Construction, LLC, hereinafter designated the “CONSTRUCTION MANAGER AT RISK” or “CM@Risk”, collectively referred to herein as, “the parties”.
