is intended to be used for a ’military end-use,’ as defined in paragraph (d) of this section, in Country Group D:1 (see supplement No. 1 to part 740 of the EAR); or by a ’military end-user,’ as defined in paragraph (e) of this section, in Country Group D:1. This license re- quirement does not apply to exports or reexports of items for the official use by personnel and agencies of the U.S. Government or agencies of a cooper- ating government. See § 740.11(b)(3) of the EAR for definitions of ‘‘agency of the U.S. Government’’ and ‘‘agency of a cooperating government’’.
