This End User Assessment Agreement (“Agreement”) is entered into by and between Veracode, Inc., a Delaware corporation with offices at 65 Network Drive, Burlington, Massachusetts 01803, (“Veracode”) and the Customer entity identified on an order form referencing this Agreement (“Customer”) and shall be effective as of the last date of signature, (the “Effective Date”). The parties to this Agreement may be referred to as a “Party” singularly or the “Parties” collectively. In consideration of the promises and mutual agreements contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and intending to be legally bound hereby, Veracode and Customer agree as follows:
