These Terms and Conditions of Purchase (“Terms and Conditions”) are incorporated by reference into and constitute a part of the Purchase Order issued by Florence Corporation (“Florence Corporation”), a Gibraltar Industries company to the Supplier named therein Supplier. Florence Corporation and Supplier are sometimes referred to herein as a “Party” and collectively as the “Parties”). As used herein, “Agreement” means, collectively, the Purchase Order issued to Supplier by Florence Corporation and these Terms and Conditions, whether attached to the Purchase Order or provided separately by Florence Corporation.
