This Settlement Agreement and Release (“Settlement Agreement” or “Agreement”) is entered into by and between SHIRA KOHN and ANDRES VIVAS, individually and on behalf of Settlement Class Members (as defined in Paragraph 37) (together “Plaintiffs”), and LOREN D. STARK COMPANY, INC. (“Defendant” or “LDSCO”) (collectively the “Parties”), in the action Kohn et al. v. Loren D. Stark Company, Inc., Case No. 4:23-cv-03035, pending in the U.S. District Court for the Southern District of Texas, Houston Division (the “Action”).
