This Qualtrics Master License Agreement (“Agreement”), is between Qualtrics, LLC (“Qualtrics”); and Ordering Activity (“Licensee”). Qualtrics has developed a set of computer programs that facilitates and automates the process of conducting surveys (the “Software”). Access to the Software is provided by Qualtrics as a service to Licensee via an ASP (Applications Service Provider) model, in which the Software is hosted on servers of Qualtrics or of a third party engaged by Qualtrics, where the third party is in the business of hosting Internet services and/or applications.
