Where the rights, power and authority itemized above are modified or limited by the terms and provisions of this Collective Agreement, they shall only be modified or limited to the extent specifically provided for therein. Failure by the Company to exercise any of its Management Rights or other rights shall not be considered to be an abandonment of those rights nor shall the principle of estoppel be applied to such circumstances. The Company will not exercise its rights contrary to the express provisions of this Collective Agreement.
