These General Terms and Conditions (these “General Terms”), published at www.mmodal.com/login/reference-documents/, apply to any order form, purchase order, statement of work, change order, work request, end user licensing agreement, and similar arrangement (such documents together with these General Terms are hereinafter referred to as an “Agreement”) entered into by MModal Services, Ltd. and/or its Affiliates (hereinafter referred to as “M*Modal”) and any purchaser of goods or services or licensee of software from M*Modal (hereinafter referred to as “Client”). These General Terms prevail over any Client’s general terms and conditions regardless whether or when Client has submitted its order form, purchase order, statement of work, change order, work request, end user licensing agreement or similar document. Fulfillment of any Agreement does not constitute acceptance of any Client terms and conditions and does not serve to modify or amend these General Terms unless expressly agreed to
