The Participant, the person set forth on the Application Form, sometimes also referred to as “you” residing at the home address also set forth on the Application Form (the “Premises”) agrees to enter into this Pilot Project Agreement (“Agreement”) with NewPower Holdings, Inc. and its affiliated companies (“NewPower”). This Agreement is effective as of the Effective Date, which shall be the date the Equipment described below is installed on the Premises. As of the Effective Date, you agree to the terms and conditions set forth in this Agreement.
